Welcome to Foukhari LTD! The terms “we”, “us” and “our” refer to Foukhari. Foukhari operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Foukhari is powered by Shopify, which enables us to provide the Services to you.

The following Terms of Service (the “Terms”), together with any policies referenced herein, describe your rights and responsibilities when you use the Services.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms. If you do not agree, you should not use or access our Services.

By agreeing to these Terms, you represent that you are at least 18 years old or the age of majority in your jurisdiction, and that you have the right and capacity to enter into a binding agreement.

You may be asked to provide information (such as your email, billing, and shipping details) to use the Services. You warrant that this information is accurate and up to date.

You are solely responsible for maintaining the confidentiality of your account and for all activity under it.

SECTION 2 – OUR PRODUCTS

Our ceramics and accessories are handcrafted by Moroccan artisans, meaning each piece is unique. Variations in size, color, and finish are natural and expected.

All content on the site (including designs, images, graphics, and text) is the exclusive property of Foukhari. Unauthorized reproduction or use may result in legal action.

Images are for illustration purposes only, and actual products may vary slightly due to handmade processes.

SECTION 3 – ORDERS

When you place an order, you make an offer to purchase. Foukhari reserves the right to accept or decline any order at its discretion. Orders are only confirmed once payment has been received and you receive an order confirmation email.

For B2B orders, due to artisanal production, manufacturing may take 8–12 weeks. Delivery timelines are estimates only and may be extended due to customs, strikes, weather, or other superior force events. In any case, we will make reasonable efforts to deliver within a maximum of 21 business days after production is completed.

SECTION 4 – PRICES AND BILLING

Prices are shown in your selected currency and may or may not include taxes, customs, or shipping depending on your location. Prices are subject to change without notice.

For exclusive partners and wholesale agreements, payment terms are:

  • 40% deposit upon order confirmation

  • 60% prior to shipment

You agree to provide valid and authorized payment information.

SECTION 5 – SHIPPING AND DELIVERY

Delivery times are estimates only. We are not responsible for delays caused by carriers, customs, or events outside our control. Once an order is handed to the carrier, risk of loss transfers to you.

SECTION 6 – DEFECTIVE PRODUCTS & WARRANTY

You must inspect your products upon receipt. Any claim for defects must be made immediately and within 14 days of delivery by contacting our customer service team 📧 sales@foukhari.com |  📞 +972-54-8290352.

If a defect is confirmed to be a manufacturing fault, we will replace the item with a similar product or issue a refund if replacement is not available.

  • If you fail to report within 14 days, the product will be deemed accepted.

  • The burden of proof that the defect was not caused by misuse after receipt lies with the customer.

SECTION 7 – REFUND AND CANCELLATION RIGHTS

In accordance with the Israeli Consumer Protection Law (1981), you may cancel your order as follows:

  1. Before shipment – Refund minus 5% of the transaction value or ₪100 (whichever is lower).

  2. After shipment – Refund minus 5% or ₪100 (whichever is lower), plus shipping/handling charges. Products must be returned unused, undamaged, and in original packaging.

  3. Discounted items – Refund only within 2 business days of receipt, under the same conditions.

  4. Custom or personalized products – Not eligible for cancellation.

  5. Refunds will be issued via the original payment method and are subject to processing timelines of your credit card company or payment provider.

SECTION 8 – ERRORS IN PRICING OR AVAILABILITY

If a product is listed with an incorrect price or stock information, Foukhari reserves the right to contact you before processing, or cancel the order and issue a full refund.

SECTION 9 – INTELLECTUAL PROPERTY

All designs, patterns, images, and product descriptions are owned by Foukhari, our artisans, or licensors. Unauthorized copying, reproduction, or use is prohibited.

SECTION 10 – PRIVACY AND DATA SECURITY

We collect and use personal information in accordance with our Privacy Policy. Payments are processed through secure third-party providers. Foukhari is not directly responsible for the systems of these providers.

SECTION 11 – THIRD-PARTY TOOLS AND LINKS

Our website may include links or tools from third parties. We are not responsible for their content, policies, or products. Use at your own risk.

SECTION 12 – TERMINATION

We may suspend or terminate your access to the Services at any time if you breach these Terms.

SECTION 13 – DISCLAIMER OF WARRANTIES

Except as expressly required by law, all products and Services are provided “as is” without warranties of any kind. Handmade variations are not considered defects.

SECTION 14 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Foukhari shall not be liable for indirect, incidental, or consequential damages, including lost profits, arising from your use of the Services or products.

SECTION 15 – INDEMNIFICATION

You agree to indemnify Foukhari, Shopify, and their affiliates from claims arising from your breach of these Terms or misuse of the Services.

SECTION 16 – SEVERABILITY

If any provision is found unenforceable, the remainder shall continue in effect.

SECTION 17 – GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of Israel, with exclusive jurisdiction in the competent courts of Tel Aviv-Jaffa.

SECTION 18 – CHANGES TO TERMS

We may update these Terms from time to time by posting changes on our website. Continued use of the Services constitutes acceptance of such changes.
